“There’s a recognition that the court decisions have not all gone the same way and that there’s the potential that some algorithms that may have risks to competition are going to be found lawful under the antitrust laws,” said Harrison McAvoy, a partner at antitrust boutique Shinder Cantor Lerner. “So the regulatory or legislative approach may be the only way to address concerns for increased prices, from the regulator’s perspective.”
