SCL Partner Wyatt Fore recently provided his insights on the Google Search remedies decision in a conversation with The National Law Journal. In the article, “‘Very Persuasive’: US Judge’s Google Search Remedies Decision Tailored to Circuit Precedent, Litigators Say”, Wyatt had the following to say:
“This is a very serious remedy,” said Fore, a partner at the antitrust litigation boutique Shinder Cantor Lerner. “He obviously doesn’t go as far as what the government wanted. … It is a middle-of-the-road decision. Not a slap on the wrist, and not draconian.”
Wyatt further noted the decision is likely to be read persuasively by the D.C. Circuit:
“He really did his homework both on the findings of fact and the conclusions of law,” antitrust litigator Wyatt Fore said Wednesday of Mehta’s ruling. “He showed his work. As a result, I think it is going to be very persuasive to an appellate court.”
